These Terms and Conditions set out the basis on which Rubbish Removal West Hampstead provides rubbish removal and waste collection services to domestic and commercial customers. By making a booking, you agree to be bound by these Terms and Conditions, which form a contract between you and Rubbish Removal West Hampstead.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means the individual, business, company, or organisation that requests or receives rubbish removal or waste collection services from Rubbish Removal West Hampstead.

Services means any rubbish removal, waste collection, clearance, loading, transportation, and related services provided by Rubbish Removal West Hampstead.

Waste means any items, materials, junk, rubbish, or refuse presented by the Customer for collection and removal as part of the Services, except items expressly excluded under these Terms and Conditions.

Booking means a confirmed request for Services made by the Customer and accepted by Rubbish Removal West Hampstead by telephone, email, online form, or other agreed communication method.

Quotation means the price or estimated price provided by Rubbish Removal West Hampstead for the provision of Services, based on information supplied by the Customer.

2. Scope of Services

Rubbish Removal West Hampstead provides waste collection and rubbish removal services, including but not limited to household clearances, garden waste removal, office and commercial clearances, bulky item collections, and general junk removal. The exact Services to be provided for each Booking will be agreed at the time of Booking.

Services are provided at the address specified by the Customer in the Booking. The Customer is responsible for ensuring that the address and access details are accurate and complete.

Rubbish Removal West Hampstead reserves the right to refuse to collect any items which are hazardous, prohibited, unlawful to transport, or unsuitable for the equipment used, or which are not as described at the time of Booking.

3. Booking Process

Bookings can be made by telephone, email, or through an online enquiry, subject to availability of collection slots. All Bookings are subject to acceptance by Rubbish Removal West Hampstead.

When making a Booking, the Customer must provide accurate details of the type and approximate quantity of Waste, access conditions, parking arrangements, and any special requirements or restrictions at the collection address.

Based on the information provided, Rubbish Removal West Hampstead will give a Quotation, which may be a fixed price or an estimate based on volume, weight, labour, or time required. Any Quotation is provided in good faith but does not become binding until confirmed at the time of collection after assessment of the actual Waste and access conditions.

The Customer is responsible for ensuring that an authorised person is present at the collection address at the agreed time to grant access, confirm the Waste to be removed, and approve any variations to the Quotation if required.

4. Service Availability and Timing

Rubbish Removal West Hampstead will use reasonable endeavours to attend the property within the agreed collection window. However, all dates and times given for attendance are estimates only and may be affected by traffic, weather conditions, operational issues, or events outside our control.

If we expect a significant delay, we will take reasonable steps to inform the Customer and arrange a revised time or alternative date for collection where possible.

Rubbish Removal West Hampstead is not liable for any loss, cost, or inconvenience caused by delay or non-attendance arising from circumstances outside our reasonable control.

5. Access, Parking and Customer Obligations

The Customer must ensure that safe, unobstructed, and reasonable access is available to the collection address and to the Waste to be removed. This includes providing accurate information on access restrictions such as narrow roads, height limits, security gates, or internal restrictions such as staircases or fragile flooring.

The Customer is responsible for arranging any necessary parking permits or authorisations and for ensuring that our vehicle can be parked close enough to the property to enable efficient loading. Any parking charges, penalties, or fines incurred as a result of inadequate arrangements or inaccurate information provided by the Customer may be added to the final invoice.

The Customer agrees to ensure that the collection area is safe for our staff and that any known risks, such as loose flooring, sharp objects, or hazardous materials, are disclosed in advance.

Rubbish Removal West Hampstead reserves the right to refuse to carry out all or part of the Services if, in our opinion, access is unsafe, unreasonable, or likely to cause damage to property, vehicles, or persons. In such cases, a call-out or cancellation charge may apply.

6. Waste Types and Exclusions

Unless expressly agreed in writing, the Services do not include the collection of certain wastes such as asbestos, medical waste, clinical waste, chemicals, solvents, pressurised containers, gas bottles, fuel, corrosive substances, explosives, or other hazardous or specialist materials.

If prohibited or hazardous items are presented for removal without prior agreement, Rubbish Removal West Hampstead may refuse to collect them and may at its discretion either remove only the non-hazardous Waste or cancel the Services. Any additional costs, including disposal fees or specialist contractor charges, will be the responsibility of the Customer.

The Customer is responsible for notifying us if any items require special handling under applicable waste regulations. Failure to disclose such items may result in additional charges, refusal of collection, or termination of the agreement.

7. Pricing, Quotations and Additional Charges

Prices are based on the information provided by the Customer at the time of Booking, including the estimated volume, weight, and type of Waste, as well as loading conditions, site access, and time required.

On arrival, our team will assess the Waste and confirm or adjust the Quotation where necessary. If the actual Waste or conditions differ significantly from those described, Rubbish Removal West Hampstead reserves the right to revise the price. Any change in price will be explained to the Customer before work starts.

Additional charges may apply for heavy materials such as soil, rubble, bricks, tiles, or for excessive dismantling, sorting, or additional labour required beyond what was reasonably anticipated. Waiting time charges may apply if our team is kept waiting beyond an agreed free waiting period due to delays on the part of the Customer.

8. Payments and Invoicing

Unless otherwise agreed in writing, payment is due on completion of the Services on the day of collection. Rubbish Removal West Hampstead accepts commonly used payment methods, which may include cash, bank transfer, or card payment, as advised at the time of Booking.

For commercial Customers or account holders, payment terms will be specified on the invoice. If no terms are specified, payment is due within 7 days of the invoice date.

If payment is not received by the due date, Rubbish Removal West Hampstead reserves the right to charge interest on overdue sums at the statutory rate, together with any reasonable costs incurred in recovering the debt.

9. Cancellations, Rescheduling and Failed Collections

The Customer may cancel or reschedule a Booking by contacting Rubbish Removal West Hampstead. Where possible, we ask for at least 24 hours notice before the scheduled collection time.

We reserve the right to apply a cancellation or call-out fee for same-day cancellations, short notice cancellations, or where our team attends the property and is unable to complete the collection due to circumstances within the Customer's control, including but not limited to lack of access, absence of an authorised person, or unsafe conditions.

If Rubbish Removal West Hampstead needs to cancel or reschedule a Booking, we will use reasonable endeavours to provide as much notice as possible and offer an alternative time. We are not liable for any indirect or consequential losses arising from such cancellation or rescheduling.

10. Performance of Services and Customer Satisfaction

Our team will carry out the Services with reasonable care and skill, taking reasonable steps to protect the Customer's property and premises while loading and removing Waste.

On completion of the collection, the Customer or an authorised representative should inspect the work. Any concerns about the Services should be raised at the time of collection wherever possible so that we can seek to resolve them promptly.

Rubbish Removal West Hampstead aims to provide a professional and reliable rubbish removal service across the local area. If you are dissatisfied with any aspect of the Services, you should notify us in writing as soon as reasonably practicable with details of the issue.

11. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited or excluded under United Kingdom law.

Subject to the above, Rubbish Removal West Hampstead is not liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the provision of the Services.

Our total liability for direct loss or damage to property caused by our negligence in the course of providing the Services is limited to the lesser of the cost of repair or replacement of the damaged item or a reasonable sum proportionate to the price paid for the Services giving rise to the claim.

The Customer is responsible for removing or securing any items of particular value or fragility prior to our arrival. We do not accept liability for damage to items that were not reasonably visible, were already damaged, or were not properly secured.

12. Waste Handling and Environmental Compliance

Rubbish Removal West Hampstead is committed to handling and disposing of Waste in accordance with applicable waste management and environmental regulations in the United Kingdom. We will ensure that Waste collected as part of the Services is transferred only to authorised facilities or carriers.

The Customer confirms that they are the owner of the Waste or have the owner's permission to arrange for its removal and disposal. The Customer agrees that title to the Waste passes to Rubbish Removal West Hampstead at the point of collection, subject to compliance with relevant laws and regulations.

We may separate, reuse, recycle, or recover materials from the Waste as appropriate. The Customer consents to such processing and acknowledges that no payment or value is due to them in respect of any reclaimed items.

13. Customer Data and Communications

In order to provide the Services, Rubbish Removal West Hampstead will collect certain personal and contact details from the Customer, such as name, address, telephone number and payment information. This information is used only for the purposes of managing Bookings, providing Services, processing payments, and related administration.

By providing their contact details, the Customer consents to being contacted by telephone, email, or message in relation to their Booking and the Services. We may retain records of Bookings and invoices for accounting and legal compliance purposes.

14. Complaints and Dispute Resolution

If the Customer wishes to raise a complaint about the Services or any aspect of these Terms and Conditions, they should contact Rubbish Removal West Hampstead using the contact details provided on their invoice or confirmation. We will investigate and respond to complaints within a reasonable time.

We will endeavour to resolve any disputes amicably through discussion. If a dispute cannot be resolved, the parties are free to seek independent legal advice or pursue any remedies available under United Kingdom law.

15. Amendments to Terms and Conditions

Rubbish Removal West Hampstead may update or amend these Terms and Conditions from time to time. The version in force at the time of Booking will apply to that Booking. Customers are encouraged to review the latest version of the Terms and Conditions when making a new Booking.

16. Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of rubbish removal and waste collection services by Rubbish Removal West Hampstead.

18. Entire Agreement

These Terms and Conditions, together with any Booking confirmation and agreed Quotation, constitute the entire agreement between Rubbish Removal West Hampstead and the Customer in relation to the provision of the Services and supersede any prior agreements, discussions, or understandings, whether written or oral.

By making a Booking and permitting our team to perform the Services, the Customer confirms that they have read, understood, and accepted these Terms and Conditions.
